highly recommended that you monitor your email after you
have placed your order in case an issue arises.
We do not store your credit
card information, we do not even see it. Your order is

Encryption. This is to protect you, your identity and your
personal information.
Limitation of Liability:
The Forever Rose
shall not be liable for any special or
consequential damages that result from the use of, or the
inability to use, the materials on this site or the
performance of the products, even if The Forever Rose
has been
advised of the possibility of such damages. Applicable law
may not allow the limitation of exclusion of liability or
incidental or consequential damages, so the above limitation
or exclusion may not apply to you.
Typographical Errors:
In the event that a Forever
Rose
product is mistakenly
listed at an incorrect price, The Forever Rose
reserves the
right to refuse or cancel any orders placed for product
listed at the incorrect price. The Forever Rose
reserves the
right to refuse or cancel any such orders whether or not the
order has been confirmed and your credit card charged. If
your credit card has already been charged for the purchase
and your order is cancelled, The Forever Rose
shall issue
a credit to your credit card account in the amount of the
incorrect price plus additional shipping and handling
charges.
Email Offers and/or Newsletter:
By agreeing to these terms and
conditions The Forever Rose
may periodically send you an email notification about new
products, promotion, sales and discount coupons. These email
are rare and will never occur at intervals of more than
twice per calendar month. When and if you receive an email
from The Forever Rose
you will always be given the option to unsubscribe by simply
replying to the email.
Payment Methods:
We accept online payments by VISA,
MasterCard, Discover
and PayPal. You can send check*
or money order* payments (Made payable to The Forever Rose) to: The

* Personal
checks will be held for 7 - 10 business
day (until the check has cleared) before
we ship your order. Please keep this in
mind if paying with a personal check!
Out of Stock:
Every attempt is made
to make sure that out of stock items are
noted online as soon as the item is no
longer in stock. If for some reason you
place an order for an item that is out
of stock we will email you to make sure
that you are aware of the situation as
well as to update you on when your item
will be back in stock.
Returns:
We are sure that you will be happy with
your purchase. If for some reason you are not satisfied with
your purchase, you may return you item(s) within 10 days for a full
purchase price refund. Shipping charges can not be refunded.
If your order qualified for FREE shipping, the actual
shipping charges will be deducted from your refund. All
refunds are credited back to the charge card used to make
the original purchase. Items must be returned in original
packaging within 10 business days from the time you received
your order. It is strongly suggested that you insure any
returns as we cannot offer a refund on items damaged during
return transit without this insurance.

Damaged in shipping:
This is a rare
occasion but if your purchase is defective or appears to
have been damaged in transit, please contact us immediately
at 570-640-0963 or email us at
email@theforeverrose.com so that we can have the package
inspected. Please retain the shipping box and all packaging
materials. Items must be
returned in original packaging.
Notice:
The Forever Rose
may deliver notice to you by means of e-mail, phone or by other reliable
method to the information you have provided to us
during checkout. We will only contact you if there is a
problem with your order.
Miscellaneous:
Your use of this site shall be governed in all respects
by the laws of the state of Pennsylvania, U.S.A., without regard
to choice of law provisions, and not by the 1980 U.N.
Convention on contracts for the international sale of goods.
You agree that jurisdiction over and venue in any legal
proceeding directly or indirectly arising out of or relating
to this site (including but not limited to the purchase of
Forever Rose
products) shall be in the state or
federal courts located in the County of Schuylkill,
Pennsylvania.
Any cause of action or claim you may have with respect to
the site (including but not limited to the purchase of
Forever Rose
products) must be commenced within one (1)
year after the claim or cause of action arises. The Forever
Rose
failure to insist upon or enforce strict
performance of any provision of these terms and conditions
shall not be construed as a waiver of any provision or

Warranty Disclaimer:
The Forever Rose
guarantees all products purchased from
www.theforeverrose.com website against manufacturing defects for 12 months
(one year) from the date of purchase. The original purchase receipt is required
to file a warranty claim. This warranty does NOT cover tarnish on any Silver
products. This warranty does NOT extend to Forever Rose
products purchased through one of our vendors, affiliates, dealers, etc.. The
Forever Rose reserves full
rights to examine questionable merchandise and reserves full and exclusive
rights to determine validity of any defects.
To the fullest extent permissible pursuant to applicable law, The
Forever Rose
disclaims all warranties, express or implied, including, but
not limited to, implied warranties of merchantability and fitness for a
particular purpose and non-infringement.
2009 Shipping Holidays
UPS will not pick-up or deliver on Saturday or
Sunday. If you would like to inquire about UPS Saturday delivery which may be available for an additional surcharge, please
call us at 570-640-0963 for a Saturday delivery price quote.
Saturday delivery is not an available option in all areas. UPS
will under no circumstances deliver on Sunday or the following
holidays within
the USA:

We do reserve the right to refund money and not ship to a
country not listed above.
International Orders range from $18.95 to $34.95+ per order.
The FREE Shipping with orders of $75 or more applies to US domestic orders only
and not to international orders (all orders outside of the US).
Please be sure to select the appropriate shipping option during checkout. The
Forever Rose shipping charges do not include any customs fess or taxes. All customs taxes and
fees are to be paid by the recipient -
please see below.
International Custom Fees, Import Taxes, Duties
and Other Fees:
International orders may be subject to customs fees, import taxes, duties, or
other fees imposed by your government. The Forever Rose does not
charge these fees, and in most cases we have no advance knowledge of or control
over the amount of the fees. All such fees are the responsibility of the
purchaser and are not included in the shipping charges quoted to you during your
purchase, either online or via telephone. Please contact your customs
office for information about additional fees that may apply. If you refuse
delivery on a package, you are responsible for the return shipping costs, as
well as any outstanding duties, fees, tariffs or taxes.

certain countries at our discretion. We ship to the United States, Canada,
United Kingdom, Australia, New Zealand and many other countries. If you

Shipping Times:
Here is an estimate of how long it will take for you to receive a
Forever Rose from the time that your order ships. We try to ship all orders
within 1 business day from the time an order is received. If there is any
further delay in shipment, other than an item noted as out of stock on our
website, we will contact you of the possible delay.
APO's- Approx 5-10 business days from the date that your order ships. These
orders are always shipped via United States Postal Service.
AUSTRALIA & NEW ZEALAND- Approx 5-7 business days from the date that your
order ships. These orders are generally shipped via United States Postal
Service.
CANADA - Approx 2-6 business days from the date that your order ships
depending on your location in proximity to PA, USA. These orders are generally
shipped via USPS.
UK - Approx 4-7 business days from the date that your order ships. These
orders are generally shipped via United States Postal Service.
Note: We do not gift wrap international orders due to
strict Customs regulations.
